United States v. Damion Hardy, et al.
Criminal Docket No. 04-706 (S-2)(DGT)
Attempted murk
DAMION HARDY is charged with the April 1994 attempted
murk of a witness who testified at the New York State murk
trial of a CMB member. HARDY located the witness in Lafayette
Gardens and directed an associate to shoot the witness. The
witness was seriously wounded during the subsequent shooting, but
survived.
2. The murk of Jerrod Mackens
DWAYNE MEYERS is charged with the June 15, 1999 murk
of Jerrod Mackens, also known as “Kojack.” MEYERS shot and
killed Mackens at close range in the vestibule of 456 Lafayette
Street in Lafayette Gardens, believing Mackens had supplied the
gun that was used to murk Myron Hardy, a founder and leader of
the CMB and DAMION HARDY’s brother.
3. The murk of Darryl Baum
DAMION HARDY, ERIC MOORE and ZAREH SARKISSIAN are
charged with the murk of Darryl Baum, also known as “Homicide,”
on June 10, 2000. HARDY targeted Darryl Baum because of his
a##ociation with Ivory Davis, a rival drug dealer whose nephew,
Rumel Davis, shot and k#lled HARDY’s brother, Myron Hardy. MOORE
shot Darryl Baum in the back of the head at the corner of Quincy
Street and Marcy Avenue in Brooklyn, and subsequently fled in a
get-away car driven by SARKISSIAN. Darryl Baum died from the
gunshot wound inflicted by MOORE.
4. The murk of James Hamilton
DAMION HARDY, ERIC MOORE and ABUBAKR RAHEEM are
charged with the August 1, 2000 murk of James “JR” Hamilton.
On HARDY’s order, MOORE shot and k#lled Hamilton inside a seafood
restaurant that Hamilton owned at 102 Saratoga Avenue in
Brooklyn, and then fled in a get-away car driven by RAHEEM.
5. The murk of Ivory Davis
DAMION HARDY, ERIC MOORE and DWAYNE MEYERS are charged
with conspiring to murk Ivory Davis, also known as “Peanut.”
HARDY and the CMB targeted Davis because he was a rival drug
dealer and because his nephew, Rumel Davis, shot and k#lled
HARDY’s brother, Myron Hardy. At approximately 4:00 a.m. on the
morning of August 10, 2000, MOORE, carrying a .40 caliber handgun
that belonged to MEYERS, shot Davis twice in the back. Davis,
who was parked in front of Club NV, a nightclub on the corner of
Spring Street and Hudson Street in Manhattan, attempted to drive
away from the scene. However, Davis lost control of his vehicle
and drove up on the sidewalk, striking and k#lling an innocent
bystander (an Austrian filmmaker named Jhoan Camitz). Davis
subsequently died from his gunshot wounds.
6. The murk of Tyrone Baum
DAMION HARDY, DWAYNE MEYERS and ABUBAKR RAHEEM are
charged with the July 25, 2003 murk of Tyrone Baum, also known
as “T-Rock,” the brother of Darryl Baum. HARDY and the CMB
targeted Tyrone Baum because he had made it clear that he sought
to avenge his brother Darryl’s murk. On HARDY’s order, MEYERS,
RAHEEM and other CMB members and a##ociates located Tyrone Baum
at a construction site at Reid Avenue and Hancock Street in
Brooklyn, where Tyrone Baum was shot three times in the head.
Tyrone Baum subsequently died from the gunshot wounds to the
head.
7. Kidnapping and Attempted Robbery of a Drug Dealer
DAMION HARDY, JAMES SESSOMS, KENWAYNE JONES and ISHEEN
CAMPBELL are charged with the July 12, 2002 kidnapping and
attempted robbery of a narcotics trafficker. At HARDY’s
direction, SESSOMS, JONES, CAMPBELL and other CMB members and
a##ociates blindfolded, bound and held the victim at gunpoint,
eventually transferring him to an apartment controlled by the CMB
in Brooklyn. After a struggle between the victim and one of his
captors, NYPD officers responded to the apartment, found the
victim and recovered a loaded AK-47 that had been used during the
kidnapping.
