Whether it makes sense or not it has been going on in the league before we were even born.

Not consistently. It is generally based on who will benefit. When the Lakers are playing defense at the end of games and hack people, we always hear that "let the players decide the game" nonsense but when the tables are turned, there is a parade to the free throw line. When it is generally accepted for referees to put the rulebooks away at their own discretion, that is what happens.
