If they release the tape and it shows no potential harm than we can have a dialog on privacy and a parents rights to discipline children. But you got to release the video first.

The incident went down at Vasquez Rocks in Santa Clarita, CA. Charlize and Sean were having a sunrise picnic when a female hiker with a camera stopped after she heard Charlize's 2-year-old son Jackson screaming in a tantrum. The hiker went towards the child and started filming.
We're told Charlize told the woman not to go near Jackson, so the hiker left and called the cops and claimed something bad might have happened to the kid.
We're told the deputies quickly determined nothing happened. Jackson was just on a timeout and got really upset. The deputies concluded the timeout involved no physical contact, so they left and no action will be taken
That sounds a bit different then AP's case. First off if the lady filming saw any act of child endangerment and "left and called the cops" she should be partial to blame, calling the cops is cool but why leave? I am willing to bit this kid threw a hissy fit, it was someone famous so of course your going to video/take pics. I wouldn't put this in the AP category just yet, now again, lets see this "video" if its just of a baby going crazy crying and pissed, whatever. If its sean penn beating this kid down, arrest him, arrest Charlize and the damn girl who left.
Again I could be completely wrong, but I think TMZ is just reaching on this one. It's like when there is a Shark Attack, next thing you know there is 40 reports of shark attacks, its just a hot subject right now so they want to leech onto it to get more website hits.
