This is a weird case. In a criminal case where there’s an asserted immunity defense or double jeopardy, the general thinking is if the defendant is right, he shouldn’t have to sit through a trial. So these are the rare criminal appeals that get settled before trial, which mean trial can’t advance till it’s settled.

I think DC COA decides it quickly. And SCOTUS punts, and we’re on track for an April trial.

I think the concern is that there are cyber sleuths (who typically rely on whatever footage is provided to the public) that would work to identify insurrectionists the DOJ misses. I'm prolly wrong though? maybe the DOJ is being thorough or tapping in with the online communities.
