aight so check it, my roommate got arrested the other day. the cop pulled him over for riding a BIKE, yes as in bicycle. for not having a flashlight :rudy:

anyway, you already know he had to harass and search him. my roommate is white so this wasnt a racial thing. he got caught with a lil bag of weed, prolly a few grams of some reggie, and a lil bowl.

now he has to go to court or whatever. my question is, is there hope for him as far as getting a lawyer and getting the charge dropped ? as far as i kno thats an illegal search but i mean he was on a bike, so its different than being in a car. basically what i wanna know is are there any loopholes around this ? and how does it work with paying lawyers cuz this dude aint got bread like that.

im in FL by the way

As far as lawyers, most take payment plans if you put down at least half on the down payment. You want to get a lwyer who was an ex prosecutor in you county if you can. They will already have relationships established in the courthouse, and that shyt means everything

It's not illegal because it's not like your friend said no, you can't search me, where is your search warrant. By letting the cop search him, he is giving them permission. If it is your friends first offense, I think he can probably get the charges dropped by a good lawyer.

Riding a bike at night without a light is a citation. They can legally stop you, issue that shyt, and find a bullshyt reason to search you. Trust me, I caught a felony and went to prison over the exact same situation. I spent a grip on a decent lawyer too

the problem here is....he just beat something similar only a few months ago. he had to take a couple piss tests, when he got his 3 clean piss tests, he dodged probation. so now what hes worried about is they gonna say "not this tiiiiiiime". i cant let this dude get probation cuz then that means IM gonna have to live like im on probation when i aint do shyt, and i aint havin that

the problem here is....he just beat something similar only a few months ago. he had to take a couple piss tests, when he got his 3 clean piss tests, he dodged probation. so now what hes worried about is they gonna say "not this tiiiiiiime". i cant let this dude get probation cuz then that means IM gonna have to live like im on probation when i aint do shyt, and i aint havin that

Polygraph, did you read my post? If it was at night time, then the search was legal. I'm pretty sure it was at night cause you mentioned flashlight. The citation is literally called riding a bike without a light or some shyt. It's a bullshyt way cops used to search nikkas who be trapping on bikes in the hood. If you ever see a nikka in the hood at night on a bike with a light on it, it's a 99% chance they got some dope on them

oh ok. yeah it was at like 2:30 in the morning. well that fukkin sucks then. its fukked up cuz he wasnt even riding on the street, he was on the sidewalk. i kno its not much a difference but still. fukkin crackas aint got nothin better to do. so is there hope for this nikka at all then? i told him he gon have to come outta pocket on a lawyer. i'd rather spend 5X more money on beating the charge than getting probation. fukkkkk that! all i know is this...if he gets probation....IM OUT!

I think that your friend can argue that he did not consent to a search so the evidence against him is dismissible but yeah get a lawyer.

lol, it wont be that serious man, if this is his only his second weed charge he will be good. On some real shyt I would just chill and see what the public defender says before I spend money on a lawyer. If they talking probation, then you can holla at a lawyer, but it wouldn't for more then a year. And even so, they will let you off as soon as you pay the probation fees anyway. When I got out, I had a year probation. I paid all my fees and restitution in like 3 months and they let me off. This was felony probation.

Also, if he does get probabtion, it won't affect you. Even on Felony probation, my P.O only popped up on a nikka like twice. On misdemeanor probation they won't do no shyt like that. Trust me you will be fine.

Trust me dog, he can't win this one. The nikka would probably have to get Johnny Cochran (rip) He was riding a bike a night without a light. You can't do that in Florida. They have been using this technique on dopeboys down here for years.

Well, if he got arrested, then the "search incident to arrest" was legal. Just to clarify, when you get pulled over for a traffic violation and get a ticket, you are getting arrested and released on a summons. The cop could bring the driver down to get booked but they would get released anyway. So, it's a way not to clog up the jail and use up police time. So, because he was arrested, he was allowed to search. A cop could search a person he wrote a traffic ticket to if he wanted to.

So, it goes like this, your friend is charged with 1. riding a bicycle at night without a light, and 2. possession of marijuana.
His defense attorney can look over the case and see if there are any holes in the case. If so, he might try to work it out with the district attorney's office to plead guilty to the bicycle no light charge if they drop the possession charge. If the case is air tight, he might try 1. to get the bicycle no light charge dropped, 2. plead guilty to possession, 3. he'll get time handed down but they'll request to suspend time, 4. pay fees and 5. perform community service.
If he wants to represent himself without a lawyer, he can just plead not guilty, guilty or no contest; and get whatever is handed down.

Repeat offenders will have a harder time getting time suspended if their last conviction was not long ago.

He can try to work something out with the DA's office and the police department's narcotics investigators, to get the charge dropped if he narcs out on his supplier or suppliers. But these kind of deals usually work out for guys looking at big-time felony charges or federal charges by DEA; and guys who can narc out higher level dealers, mafia bosses, and king pins/ring leaders or transporters, not street-level dealers.
