-Even if Carlito is on PEDs, they could probably get around it by saying that he's not a full-time competitor, so he doesn't have to have the same rules apply to him (similar to HHH)

-WWE knows that the Colon family has ran the Puerto Rican wrestling scene for decades. They're probably trying to get access to some tape libraries or something and bringing Carlito back was part of the deal.
