What precedent is there for an artist not playing a recent song of this magnitude on tour?
Agreed. If he didn't play it at the Super Bowl I could see people questioning if it would be played due to the legal situation. After the Super Bowl performance it's obvious he don't give a fukk.

Plus how many artists just don't perform a smash hit live? Only examples that come to mind are Prince not playing a couple hits after he became more religious, and Radiohead refusing to play Creep because they hate the song.

Back to Back was nowhere near the hit NLU is and Drake was performing it at every show.
