Unfortunately he gonna do a long bid. In Texas to justify deadly force he would need to prove he was in imminent and immediate danger of of loosing his own life. Simply being harassed or even pushed doesn't cover that. His own statements to the police also contradict that as well and will be used against him. He told police the metcalf kid put his hands on him and that's why he did it. That's not being imminent fear of death. Yall need to really learn about self defense laws so you dont wind up in jail on some foolishness.

Not to mention him having a knife at a school event which means he wasn't authorized to be at the event in the first place. That's a lot of hurdles to get over. Plus majority of 30+ witnesses were classmates of Metcalf since it was at their tent. Doubt they will say anything that makes metcalf look bad. His best bet is to take a plea.

in texas, per the statute on self defense, if you're in reasonable fear of serious bodily injury you can use deadly force to defend yourself.

two 6 ft 220 lb dudes approaching 5'9" 160 lb you, for no reason whatsover, demanding you get outta your seat and leave, and then trying to physically remove you after you warned them not to touch you is more than enough to establish a reasonable fear.

george zimmerman followed and then approached trayvon martin, physically attacked trayvon, and then shot and killed that young man when trayvon, defending himself, started getting the best of him. daniel penny just choked a homeless man to death on the subway in nyc and got off on self defense, and that homeless man had no weapons and hadn't put his hands on anyone.

And what the hell do you mean he wasn't authorized to be at the event? my friend, do you know what you're talking about here? ignorance of facts, and the spreading of bad information is also the reason alotta us end up in prison.

Maybe. We'll see. But NY treats guns how Texas treats drugs. If NY can get you on that gun charge, they will. And they're not real big on self-defense using one either.

It'll come down to witnesses and if his lawyer can display that he was truly afraid for his life. Again, have a weapon on you (illegal or not) does not take away the right to defend yourself.

The size argument wont justify lethal force. Karmelo was an athlete and football player also. CB I believe. He gets hit by bigger dudes all the time and nobody will view him as frail and weak. And its not just what he said. Its what he didnt say. They tell you your words can and will be used against you which is why you dont talk to the police without a lawyer. In this case he never stated to the police his life was in danger. Karmelo dont have a scratch on him. He never even said he was being beat up. He never said he feared for his life. When asked why he did it he literally says he did it just cause he put his hands on him. There is nothing to indicate he was in actualy in any real danger of loosing his life. In fact, from what we know so far Metcalfs only intent in approaching him was to get him to leave the tent. This wasnt a street beef or something and they didnt know each other. So good luck arguing metcalf was trying to kill him.

And the knife is a huge issue. His best bet is a plea deal like I said.

Unless there is video showing him getting beat to a pulp then I'm not sure how he proves that. Karmelo had no injuries. The force used also has to be reasonable and proportionate. You also cannot provoke an attack and claim self defense also. So saying touch me and see what happens while reaching in your bag for a knife can be seen as a provocation. Grabbing someones backpack or pushing or even punching someone doesnt reach the threshold for lethal force.

And Zimmerman actually got his ass kicked by Trayvon and rightfully so. He had a broken nose and was leaking from his head. He also had corrupt connections to the legal system. He father in law was a judge I believe. That case is a terrible one to try to use.

He was not authorized to be at the event cause he had a weapon on him. The minute he brought a knife to school he was no longer authorized to be on the premises and was breaking the law. This was a school event at a school district owned facility. It happened during the school day. It was an all day track meet with multiple schools. They all took school buses to and from the event and everyone there were track athletes.

You don’t get to decide for someone else how serious a threat is, or how scared they’re allowed to be, or how far they can go in their own defense. That’s what the white people are doing. But the statute on self defense in Texas is very clear.

And having a knife doesn’t automatically disqualify Karmelo from being permitted to be there. He could be found innocent of the murder charge and punished for having the knife, and I personally know someone who was in that situation. They were punished for being a felon in possession of a firearm, but got off on a murder charge because the shooting was justifiably ruled self defense.

I still don't understand all the facts of this story. Somebody got stabbed but the victims dad is trying to make sure they don't turn it into a racial issue

Exactly why I didn't respond to him. I don't think this is a slam dunk case for the prosecutor. Karmelo has a legitimate argument that he feared for his life due to several witnesses saying that both brothers approached him and put hands on him first. I know if I'm 5'9 130 pounds and two 6 foot 200+ pound men came up to me in a threatening manner telling me to leave somewhere I have legal right to be at and they didn't have the legal right to remove me, I'm taking that as a threat on my life.

Everyone would take that as a serious threat, other than those who are looking to excuse those white boys from the responsibility of their actions causing all this.

People are acting like it was gangland and Karmelo was from the other side, and not a break in the competition because of a downpour. I wonder what the excuses will be when it comes out that there were plenty of people sitting under tents of schools they didn’t attend because they were trying to stay dry.

Asking someone to leave a tent is not a death threat. You dont need authority to speak to someone. Its called freedom of speech. Doesnt mean Karmelo had to listen though and he didnt. But the act of asking him to leave is not a threat of any kind of physical violence let alone lethal physical violence. For the self defense claim he would have to prove he was in immediate danger of loosing his life at the moment he stabbed him. In Karmelos own words he said he just touched him. Saying he was scared cause the guy was bigger means nothing.

And you are right I dont decide.. but the judge and jury (Likely full of cacs) will decide for him now how serious the threat was. And he will be sentenced to football numbers cause of it. The statue of self defense is very clear.. and he doesn't meet it in several ways. Provocation, Proportionality of force and being in imminent danger of death.

And having a weapon on school grounds does disqualify him from being there as he would be now technically trespassing. No student is authorized to be on school grounds or a school function with a knife or weapon of any kind. He knowingly carried not just to school but on the bus and to the track meet.
