Keep pushing your case. They need to actually prove you're guilty.

Are your prints on any weapons used to beat him. Does the camera show you hurting him. Do you have a reason to hurt him. Witnesses other than a malnourished and quite frankly desperate and unreliable homeless man.

Them dropping from 5 years to 1 with 4 on probation suggests to me that they don't have a sgrong case. It sickens me because they are place closing a case ahead of the life of a potentially innocent man.

Got the call last week. My lawyer said they're offering 1 year in prison, do 4 on probation now. Aggravated Battery. I declined because although I'm afraid, I am innocent. I'm definitely not going to lose everything I own by sitting in prison a year voluntarily.

Trial starts sometime this week.
i would just take that deal. If you lose in court it’s the max sentence

if you are truly innocent

make a documentary/video diary of this

give your story with interviews and details

go to court with footage

do your time with some footage when people visit you

come out....do some more interviews and give details of life before and after prison

make it a film and sell it to Netflix

She definitely wasn't trying to make it a point for me to take it. She was saying that it would be a non negotiated plea and it would be totally up to me if I took it. She said that the judge may even agree to do all probation time, but she cannot guarantee it. She said discuss it with my family, first but if we have to go to trial, "that's fine" and the judge wouldn't punish me for doing so. Whatever that means.
