Lock him up for animal cruelty. It's a fukking pug not a pitbull or german shepherd. Juding by the picture the dog was maybe 25 pounds at the most, no excuse.

shyt 1 time, I walkin home from middleschool thru this backtrail and 3 doberman mutts come out the bushes. Breh, theres nobody around and these bytches circled me, ice grillin, barkin. I started slowly started takin off my heavy ass backpack with one hand and stuck out my other hand palm up, just hoping these demons would vanish or I was prepared to go down swingin. shyts crazy in the moment tho, wasn't scared was more like let's go then. God was lookin out tho 
they just turned and wandered down the trail.
And I ran the fukk home.

Keep mutt on leash, Dog wasn't about to kill owner but you have every right to protect yourself from physical harm that is unwelcomed. So If this dog was coming up to bite he can kick it. But on the real I doubt the pugg was bloodlusted chasing joggers. It's really he say she say and how can we determine who is truly in the wrong except for owner not having a leash. Maybe dude has a dog phobia and responded involuntarily, it is a little ass pug it probably don't take too much energy to kick the life force out it's head.
