That means they get to hold on to the rights as long as they are actively producing a new movie the rights will stay with the studio. This movie was made on a lower budget so even if the movie flops in the theaters Fox will probably recoup off the DVD/Stream sales.

If it flops, I have a feeling they'll give it another shot. Maybe ANOTHER reboot or possibly a FF/X-Men crossover. Once those options are exhausted, I think they will then admit defeat and let Disney/Marvel have the rights back. There's bad blood between Fox & Marvel from what I understand, so I think it will take more than one flop before Fox gives up.

The still carry the Marvel name and casted the movie just right to where they will make their money back. And of course there will be enough special effects and explosions in the trailer to make people flock like sheep to the theaters.
