You can have your lawyer have it go through the court, perhaps the court will find a forwarding address, and if she refuses to sign the courts will ask her to appear. If she doesn't appear, you'll be granted.

Usually if the parent that has the kids first after separating they like too keep with them unless they see them dangerous and unfit to be primary one to raise them
Property wise if the other parent can't afford the place they won't give it too them in some rare cases I've seen it happen but it's cuz of some fukked up shyt the other person does the judge does that
