I am adding the exact details that eventually got Max Payne 1 & 2 working on my system in the hope that my post will help others with similar AMD Catalyst problems.
I bought the Max Payne Bundle on the weekend and like many other people on these forums was a bit peeved that the games would not start, I was running the 13.1 Catalyst drivers with my MSI Radeon 6850, most games work fine and I have not had any real issues with games since returning to PC gaming so I tried a few of the ideas mentioned on these forums with no luck until Wednesday evening, the details and the order I did them in are below.

I decided it was time to clean my system of the 13.1 Catalyst drivers as it seems a lot of the problems seem to be around this set of drivers.
2. I navigated to
http://support.amd.com/us/gpudownload/windows/Pages/catalyst-uninstall-utility.aspx and downloaded this little utility.
3. I then navigated to this page

2. I navigated to this link
http://forums.guru3d.com/showthread.php?t=370055 as these where the drivers I decided to load, Guru 3d is a very good website and has very good forums, users have great knowledge and provide plenty of computer related info.
3. I created a restore point before removing the 13.1 catalyst drivers.
4. I navigated to control panel, Programs and features and used the AMD Catalyst Install Manager to remove the 13.1 drivers from my PC, make sure that you restart your PC before going on to the next task.
5. Once the PC has restarted go to your download folder and click on the AMD cleaner utility that you downloaded earlier, this will completely remove any left over files from the previous uninstall and make sure you restart your PC after it has finished cleaning.
6. Once the PC has restarted go to the Guru 3d download AMD Catalyst 12.11 (9.010.8 November 15) AMD Official BETA 11 and run the install program, once the install is complete restart once more.
7. At this stage when I tried to run Max Payne I was gutted as once again I thought it had failed, so this is when I right clicked on the max payne exe and went into properties, Compatibility and added a tick beside run this in compatibility mode Win 98/ME, I then clicked direct on the Max Payne exe which then returned an error code, once again I could feel the steam coming out of my ears and out of luck more than anything else I thought lets click play in steam just to see what happens ..BINGO it worked and the Max Payne settings appeared on my desktop, I did not change anything this time around but when I clicked play the game ran without any problems, I closed the game down and restarted again through Steam but this time at the options screen I set everything to high and x4 Antialiasing and it started without any problems.
8. I did exactly the same steps with Max Payne 2 and the game starts up without any problems, I have not played either game for long yet but everything seems fine, graphics, frame rates and sound seem fine after fine tuning in the options settings.
I have added all this info in the hope that someone will be helped by these details as their is nothing more frustrating than purchasing games that will not start up, especially in this day and age when every penny counts, this was one of the reasons I moved away from PC gaming to consoles a few years ago but back then it was mainly Direct X problems.
