If the house is that new this should be covered by home warranty for free, right?

Never heard of that. Either way its an installation error on the part of the contractor. Had a falling out with them because of sloppy work, going over budget numerous times and fired them. As time went on I kept finding more and more wrong literally tens of thousands. Then the company I fired said I owed them. In the end it was moot point for me to try and sue them (costs) and they couldn't prove their hours or materials. Ended up getting everything done properly that I knew of with the help of a friend and his company for free. This economy has turned good people into lowlifes. I lived at the owner of the original companies lake house for a summer and they built another house for me in 08'. Just goes to show the desperation of people.

Damn man. Do you know any attorneys? It's probably too late but those contractors are bonded and insured for a reason. Glad you got it taken care of on the cheap but imo you are still owed some compensation for the shoddy work.

The cost and time of the a lawsuit makes it not worth it. In the end the chances are he wouldn't have the money.
