In February 2021, Top5 was arrested by Toronto police and charged with accessory to murder in the January fatal shooting of a college student at 40 Falstaff Avenue near Jane Street believed to be a case of mistaken identity. Top5 has been accused of being in the assailant's vehicle as the shotcaller.
He has maintained his innocence.
In March 2021, Top5 was released on bail and placed under house arrest. In May 2021, his charges were upgraded to first-degree murder. Top5 then
cut off his ankle monitor and went on the run as a fugitive.
As a wanted man, Top5 continued posting on Instagram, mocking his enemies and the police, and
began publicly beefing with John Tory who served as Mayor of Toronto from December 2014 until February 2023. The married mayor who is a father of four resigned following an inappropriate relationship with an office employee. Top5 would accuse John Tory of having attempted to have relations with “
Chair Girl” and with on-again, off-again Top5 associate and rapper-turned-pornstar
Chromazz who has previously styled herself as “Toronto’s First Lady”.
In October 2021, Top5 was arrested by police in Los Angeles, California. He had earlier
posted a video with New York rapper Bobby Shmurda who had been released from prison in February. Top5 had managed to cross the border into the US without being detected.
He was extradited back to Canada in February 2022.
While in the United States, Top5 was romantically involved with Dallas female rapper Cuban Doll. In August 2022, he alleged that
Cuban Doll began seeing him while she was in a relationship with Louisiana rapper JayDaYoungan. She broke up with him in June 2021
after she found "gay staff" on Jay's phone, according to her. This indicates
Top5 may have been in the US roughly a month after fleeing house arrest in Toronto.
In February 2023, Top5 reportedly
sent a Valentine’s Day gift to Asian Doll. The two collaborated on a song as part of Top5’s debut album or mixtape
Pedro Activated, named after his alter-ego, released on March 23. Asian Doll and Cuban Doll had been beefing since falling out of their friendship a few years earlier. The two Dallas, Texas rappers eventually squashed their beef in September 2023.
In May 2023, Top5 accused
Cuban Doll of potentially being a "confidential informant", which was echoed by fellow GGG member Saaid Mohiadin AKA "Flippa" on Instagram. Flippa is serving two life sentences, with a possibility of parole, for his alleged involvement with the targeted fatal shootings of
rapper Jerome Belle AKA "Murda" in March 2019 and of Italian-Canadian Mafia
enforcer Antonio Fiorda AKA "Scratch" in November 2019.

In June 2023, Ontario launched an
investigation into how Top5 had recorded and released a music video from within jail.
The song “21 Questions” from Pedro Activated featured Chicago and Black P Stone rapper G Herbo, and additionally, Chromazz as the lead video model.
