The plan is to get this to the supreme court.
They know lower courts will strike it down but they have endless resources now to appeal to the supreme court and they are fairly confident SCOTUS will side with them.

In this case no, birthright citizenship has been in the constitution since 1868, Roe v Wade since the 70's. Yes they'll just appeal, appeal, appeal, but even through this SCOTUS they ain't letting this pass.
