The lower courts found that he indeed violated the clause. His lawyers used delay tactics and appeals to stretch it out for years. Now the Supreme Court is refusing to hear the case because he's out of office, and therefore forcing lower courts to vacate their rulings because the Supreme Court never got the chance to review it.
