Dear Messrs. Bryant and Roberson:
We have been retained as litigation counsel by Aubrey D. Graham p/k/a “drake.” Reference is made to the Exclusive Recording Artist Agreement, as amended on February 11, 2011 (hereinafter the “Aspire Agreement”) and the tri-party distribution agreement dated as of June 16, 2008 between Mr. Graham, Aspire, and Cash Money Records, Inc./Young Money Entertainment, LLC (hereinafter “CM/YM”) (the “Cash Money Agreement”).
As you may know, Mr. Graham’s long-time counsel, ChrisTaylor, has been in discussions with Ron Sweeney concerning a possible renegotiation of the relevant agreements, discussed below. Those negotiations, ending in Mr. Sweeney’s last counteroffer from April 10, have not resulted in an acceptable resolution. Please consider this formal notice that Mr. Sweeney’s counteroffer is rejected.
In addition, and for the reasons explained in further detail below, please consider this formal notice that (1) the Aspire and Cash Money Agreements are terminated by the self-effectuating terms thereof, and (2) the respective terms of such agreements have otherwise expired and/or our client’s album commitment has been satisfied
Aspire has not paid Mr. Graham any of his 80% share of Aspire’s Share at any time during the Term of the Aspire Agreement , and at least three Albums and one EP have been commercially released which have sold in excess of 5 million units without so much as one royalty check flowing to Mr. Graham. Thus we believe that at least one such accounting/payment omission by YM/CM occurred more than 9 months ago.
nder the Aspire Agreement, Mr. Graham is only required to deliver an aggregate of forty (40) masters, or the equivalent of four “Albums” 2 containing at least ten (10) Masters each with a total duration of at least forty (40) minutes per Album. By these standards, inclusive of tracks that YM/CM and Aspire chose to package on a series of EPs, mix tapes, and formal album released, Mr. Graham has already delivered more than an aggregate of forty (40) tracks totaling over one hundred and sixty (160) minutes, thus satisfying his commitments.
Neither Aspire nor CM/YM have accounted to or paid Mr. Graham the artist royalties that are due and owing to him. Therefore, Aspire and CM/YM are in material breach of their obligations under paragraph 8 as well […] Aspire has never accounted to or paid Mr. Graham any royalties received from the sales of his records in Canada. This constitutes an additional material breach of the Aspire and Cash Money Agreements
Accordingly, both Aspire and CM/YM have wholly failed or refused to properly account to and pay Mr. Graham the amounts due to him from the sale of his recordings. As discussed in further detail below, for all royalty periods beginning in 2009 and continuing to the present, Aspire and/or CM/YM have either failed to render accounting statements, or have rendered inexcusably delayed, incomplete, confusing and misleading statements of account. In addition, Aspire’s and CM/YM’s continuous thwarting of Mr. Graham’s efforts to perform a formal audit – primarily through the unwarranted and dilatory interference of their common attorney Ronald Sweeney – have rendered the precise amount due and owing to Mr. Graham impossible to determine at this time. Worldwide sales of Mr. Graham’s EPs, albums or album equivalents are in excess of 5 Million units. It is inconceivable that Mr. Graham’s royalty account has not been recouped
Mr. Graham has authorized us to accord you five (5) days from the date hereof to schedule a meeting to discuss a resolution and settlement of the above-referenced warren of contractual breaches and business abuses[…]In the absence of an acceptable prospective restructuring of the now terminated business relationship, Mr. Graham will be forced to pursue all applicable rights and remedies to their decisive conclusion, including without limitation, the filing of litigation against Aspire, CM/YM, and any other parties as we may deem appropriate
Not surprising CM has NEVER paid artists royalties unless an artist has dragged them nto court..whats funny tho is seeing a bunch of posters who dont know shyt about the industry comment like seasoned insiders.

Why is it the folks who don't want to read and learn got the most to say about a subject they don't know about? If you just enjoy the music, enjoy it. Leave the music business matters to those who do know.
All that file says is royalty money was never paid to Drake, and now lawyers representing Drake along with Prince are now filing to demand to know where that money went. It's not hard to figure out. Almost every rapper has signed a sketchy contract before. It happens. Drake having talent doesn't exclude him from possibly missing out on money.

It says that if the company doesn't pay royalties within 15 days after it's due, then the contract automatically terminates and the management company (Cortez Bryant's) has 9 months to find another distributor and get them their payments but if this isn't done either, then the contract with Cortez/Aspire automatically terminates as well and because both of these did IN FACT happen, then there should legally be no contract which can enforce Drake to produce another album for the label
HOWEVER
If the court disagrees, then at most Drake owes 1 album to the label after which he is a free agent.
Furthermore: You guys are misunderstanding what getting raped means. Drake is still getting his show money. 50k+ for an appearance, 100K+ for a show. Livenation buy outs =5=10 Mil+ for a year of Live Nation touring events = See Paradise Club.
However, Royalties are still to be paid out to all writer/producers at a 50/50 split. Out of that 50/50 split,1/3 goes to drake, 1/3 to cash money and 1/3 goes to Aspire and out of that 1/3, 22% is supposed to go to Jas Prince. However, neither Aspire (and thus Prince) nor Drake have been paid these royalty fees and that's what they are suing for. When Jas sued, he furnished Drake's lawyer's documentation to further prove his case that no one has been paid royalties and thus YMCMB owe him some backpay.

But does Jas's contracts with Drake also get terminated since he, L'il J(I still call him that, not that other name) and Big Brother J have contracts that manage him as well?
No, the issue is over royalty money. It says that IN the file. It does speak on breach of contract yes, but the main issue brought up is how Drake has never received any royalty payments. Why else would this matter be discussed?
Anyone of any intelligence about this can see that Drake is not broke. Fair from it. That show money will keep him loaded with cash for quite some time. But he is still supposedly not getting all his money or the people behind him aren't getting their fair share.
So how are you gonna say it's not about royalty money and then turn around and break down how royalties work? I know how they work, I've gotten them myself.
