He has established tenant rights even if it was subleased. A muthafukka can squat in your vacant home and get tenant rights if they show documentation of payments and utilities established. It would require an eviction process to get them out. The apt is fukked. They handled it wrong and 100% did not consult a lawyer before doing so. The eviction process they completed was for a different apt. they would need to have one completed for this guys apt to do that on the grounds of an illegal sublease.

This lawsuit is a layup. Even he wasn't on the lease, since he's been in the apartment so long he's a legal tenant. In order to get evicted a judge has to sign off on it in court and sheriff has to execute it.
