Threats are indeed a criminal offense - whether it is a misdemeanor or felony is up to the prosecution. Ever heard of coercion or intimidation? It is most definitely a crime. Not all speech is protected, contrary to what you might think. A criminal threat is malicious harassment- occurs when someone threatens to kill or physically harm someone else or knowingly puts fear in someone else in person or in writing whether intended or not. Burden of proof is on the defense attorney to prove/disprove actual intent.
