I will say this though. If he were to pass away, the republican reaction to the vacant seat would be entirely different from what we're seeing right now with the Breyer seat. Yea some of the right wing senators are gonna light Jackson up during hearings but overall it's gonna be pretty smooth. A Thomas replacement would be pure warfare, and Biden will hopefully respond in kind by nominating a very liberal judge.

After what they did with RBG, liberals should be prepared to riot if they didn't immediately appoint a successor. And immediately get to confirming

BTW if he dies in Jan/Feb 2023, when republicans presumably hold the senate? No way they let Biden fill that seat.

i don't think biden would get to replace thomas in any event.... the gop would burn the country down before they'd let that happen... granted that even if thomas stepped down/passed away and biden replaced him, the scotus would still be 5/4 conservative...

True but it would effectively kill their plans to end Roe v Wade. Roberts has been floating compromises to avoid ending Roe v Wade for months, the other conservative justices aren't biting. With Thomas, the court almost certainly will strike it down this summer 5-4 (Roberts on minority side). Without Thomas, you get a 5-4 Roe v Wade win (Roberts on majority).

That alone would be a titanic shift, and game changer. So of course if Thomas dies, republicans are going to go insane. Not that it will matter.
