As incredible as it sounds, and not knowing too much, I have to say it was an accident. A very GOOFY accident but one nonetheless.

Now, she will or at least should STILL go to prison! As an officer you own each bullet fired from your gun. Even if you're in an actual felony, armed and dangerous shooting. If your bullet strikes a innocent bystander that's your ass!

How it should go is, even though it was a error, her handling of someone in her perceived apartment was wrong. Even as a police you can't shoot someone unless you can prove ability and opportunity for them to do you deadly harm. Shooting soon as you see them doesn't qualify.

Then again....scratch all this. This is Texas and threshold for a officer is different.

According to the law in the state of Texas you don't have any legal duty to warn or question an unlawful intruder on your property, and you can use deadlt force on them. If this was her house she was in her house and did this she would of walked that night and went back to work the next day... But that clearly wasn't her place so that's why we are here.
