They won't be able to prove that she intentionally shot him to kill him, and since she thought she was in her own apartment, it would also be hard to call her actions negligent when it comes to a trial...

It was always going to be a manslaughter charge...the real question is if they are going to go for the full 20 years...which is probably going to depend on the toxicology report...unlikely because texas actually has a intoxication manslaughter law...and she wasn't charged with that...
