In Texas......murder DOES NOT mean 'premeditated' like you came up with an elaborate plan to kill someone. The only requirement for murder is that when you pull out your weapon, did you intend to kill your target. She may have honestly thought the apartment was hers, but once she pulled out the gun with the intent to kill Botham Jean, that would constitute murder here.

Manslaughter would be the equivalent of getting into a bar fight, punching a guy in the head but he dies from brain swelling. You weren't trying to kill the guy when you punched him, but he ended up dying.

Because she's a cop, she's trained with the idea of "shoot to kill." This is exactly why they went for a murder charge. She would never pull out her gun and pull the trigger just because.

Also according to the forensics, the trajectory of the bullet was downward. The idea he was charging towards her doesn't really make any sense. She likely didn't say much of anything or give him any kind of warning. Most likely she was sexting ol dude, wasn't paying attention, freaked out at the sight of Jean, shot him and then realized it wasn't her apartment. Rather than trying to comfort him and showing remorse, her first concern was covering her own azz.

And scrubbing your social media? Nothing on the internet actually goes away.

Good post. I thought it had to be premeditated. I feel better about the case now.

she wants people to believe she got that far into what she believed was her apartment and didn't recognize her own furnishings?:rudy:

dude has his iron table out. she got all her former colleagues saying that his place reeked of marijuana , yet that wasn't clue #1 something was amiss with her fabricated story about entering the wrong apartment.:childplease:

Not buying this whole “sexting got her distracted” story. Not saying she wasn’t sexting, but she wasn’t distracted at all. You don’t bang on your OWN apartment door shouting “let me in.” Who are you shouting to? Not to mention by her being a cop, the locks on her doors were distinguishable from other residents, so how would she have mistaken it for her apartment? Plus I think his door had a red welcome mat while here didn’t.

I remember reports that she had complained about noise coming from an apartment above hers. What I think happened is she was sexting her partner and wanted him to come through, but she had to “deal with” that noise coming from above her first. When she saw it was a big black man that opened the door, she shot him right away.
