I know this case happened in Virginia, but in a kind-of-similar case, a Texas man was sentenced to 70 years for killing the boyfriend of his wife, who also said "my husband shot my boyfriend". However, the Texas guy was charged, and subsequently convicted of First Degree Felony Murder. There doesn't appear to be a pre-meditated element necessary to be convicted of First Degree Murder in Texas, only that there was intent to kill. Still, 70 years seems excessive given the circumstances.

I knew a guy who found out his wife was cheating on him. He didn’t say anything or confront her, he just went home in the middle of the day, quietly walked through the house and booted in the bedroom door where Jody was pounding his old lady. Said friend immediately set to beating on Jody and shot him (didn’t kill him). He claimed he had no idea his wife was cheating; he just came home, thought there was an intruder raping his wife and so reacted accordingly. He was never charged, never arrested and they didn’t even take his gun.

I’d have loved to have been in the room to witness his acting skills. He played the entire thing off. Obviously, immediately after the beat down/shooting occurred, his c*nt of a wife was screaming at him. She initially fled to the bathroom and locked the door. He acted completely surprised that she was cheating on him and that Jody was no intruder.
