Seems like it's on purpose/part of the story. A way to get a rematch between Gunther and Orton. Maybe with something on the line, possibly either the King of the Ring or more likely Gunther's title shot at SS. Might happen at CatC but we have to see where they go from here.
When things are mistakes they tend not to mention it. Example is Ronda's shoulder being just as much up as Randy's was but it was never talked about on the show or acknowledged/made into a story after.
