I think its weak and was partly brought for political reasons (Alvin's ambitions and desire to be Mayor of NYC or AG in a few years)
If Trump is being charged with falsifying business records than probably half of NYC business people should get charged too.
Also, I dont like how Bragg did some finessing to change misdemeanors (the falsifying business records charges) to felonies for the sake of trying to present a stronger case. In NY if you falsify business records to conceal or advance another crime, then it becomes a felony. I dont see what crime Trump was advancing or concealing. Alvin is trying to say the secondary crime to justify this being a felony was a federal campaign finance law violation on spending and some state law that prevents someone from seeking elected office using unlawful means.
I think that's bullshyt and politicans do it all the time with no ramifications. Plus it could backfire if it is ruled that state courts cannot prosecute for federal law violations. I also have the question of how the state law would apply to someone running for President and not a state office.
He also probably changed it because the statue of limitations for the misdemeanor version is 2 years, while its 5 years for the felony version.
So he may have been trying to avoid letting the statue of limitations run out since the last payment happened at the end of 2017. There can be a pause on the limitations if the person was living out of the state. Trump was in the white house for 4 years and lived in Florida after that. The pause would not help in the 2 year misdemeanor version. The limitations would still expire. But if its a felony, the 5 year version, the pause would keep limitations from expiring.
I'm 100% on board with the other 3 criminal cases and the NY Civil Fraud case. All of them are legit no question.
