I think here in lies the crux of the situation
If he FORCED her to have sex than I think he obviously committed a crime and should face some punishment for it regardless of his age
but if they had consensual sex (to the degree that a 9yo and 12yo can consent) it's an entirely different situation and I think he should get off scott free.
