Allow businesses to discriminate on the grounds of religious freedom but go hard at religious schools for doing the same?

Make it make sense to me brehs and brehettes.....

The Supreme Court is going to rule that it's okay for Yeshiva University to discriminate against LGBT clubs. This was just a technicality to make them go through the proper hoops first.



I'm guessing not too far down the road they'll also make it legal for universities to refuse to acknowledge clubs that "discriminate based on race", like a Black Student Union. The only reason I can imagine that won't end up before them is that most universities that even have a BSU would probably be too shook of pissing off their own student body to challenge it in court.

but wouldn't it be white (or asian) students at the university that would challenge the existence of the black student unions in court?

I don't think they'd have standing. They'd have to prove the BSU somehow was injurious to them and I doubt they could do it.

The only route I imagine would work is if the universities argue that race-based clubs are race discrimination, and their values prohibit race discrimination. I don't know if a university will actually try it, but I think if they tried it they'd probably win with this court.
