They didn't know they were in a bad part of town. I don't think that would have happened if they were black. Hate crime? Yes. Can they push it to that level? Maybe, if the district attorney's office feel they have enough proof. They might not want to risk losing the case so they'll go for the easier charges where they can get a guilty verdict.
