Tay-K's Co-Defendant Latharian Merritt Reportedly Sentenced to Life in Prison
A man was convicted of committing capital murder during a home invasion armed robbery by a Tarrant County jury. The defendant, Latharian Merritt, 24, from Long Beach, California, fatally shot Ethan Walker. The jury, who raised for an hour to make their decision, ruled the capital murder conviction because the death penalty was waived in this case. The capital murder conviction carries with an automatic sentence of life in prison without parole.
Rapper Tay-K, 17, who was one of the co-defendants, will not be facing the death penalty. His manager Ezra Averill confirmed that information in an Instagram story. "OH YEA AND AINT NO DEATH PENALTY OVER HERE #FREETAYK," Averill wrote. Tay-K is currently in prison awaiting trial for two capital murder charges and one count of aggravated robbery, the Fader reports.
Latharian Merritt's attorney, Tim Moore, stated that the robbers did not plan to shoot anyone. "Merritt shot Walker once in the stomach and never tried to shoot the girl who was in the room with him," Moore argued. The lack of gunplay illustrated Merritt's lack of murderous intent, according to Moore. Merritt explained during an interview with Mansfield police, "My finger must have been on the trigger, but I don't remember pulling the trigger."
