Depends what we're talking about... you can sue someone to perform if they haven't completed a contract they've signed, it's a pain in the ass, and would you want someone completing a task they were forced to lol.

I'm on both sides of this.... I'm independent.. did work for a company- they were the main company I was working for. CEO is cool so it's all good- even went to Cali and chilled with a few of the dudes.... but now he doesn't like the fact that I'm 'bossing up'. He placed madd restrictions on what I could and couldn't do as if I was an employee of his. He even tried to tell me to report to their office at a certain time each morning.
He presented me w some W2 options like I would ever work for some disgusting cac. and he wants me to sign a 'resolution agreement' that basically means that neither of us could sue.. we would need a out of court mediator.
There is another independent guy in the same boat who wants to sue but he doesn't know how and doesn't have lawyers and he wants me to be a class action with him because the ceo dude has sent madd emails as if we are employees.
of course the cac is just being greedy. i made him 85K in four months - he wants to lock me down... and/or punish me if I don't get locked down. He get 75% of each deal made... except for my deals. He thought that I was some fukk boy so we have a 50/50 split. He hates it because now I'm producing and he can't be as much of a greedy demon with me.
on the flip side:
i am not trying to be locked down because I have my own shyt.... The largest client of ol dude is also my client. I had a couple black dudes working with me... but they basically didn't work out. i have a white guy working and a chick. For future reference, I just want to know what you can make a 1099 do, because I do have requirements for both of them as far as time and expectations.
