Newly granted Apple user interface patent could cause headaches for Android camp
It seems that Android gets the most props around here, and the only stories that get attention are pro-Google or anti-Apple. Well, this is could obviously be trouble for Android phones going forward.
Of course, I fully expect to hear alot of Apple bashing going on about this, but y'all need to ask yourselves what would you do in the same situation.
Apple (AAPL) on Tuesday was granted 25 new patents from the United States Patent and Trademark Office, but one patent in particular stands out among the rest. Patent No. 8,223,134 or, the mother of all smartphone software patents, as Phandroid calls it covers the graphical user interfaces Apple designed for blogging, email, telephone, camera, video player, calendar, browser, widgets, search, notes, maps and other multi-touch interfaces. As is clear from the scope of the patent, it could spell definitely spell trouble for Googles Android partners.
Prior to Apples invention of the iPhone, most smartphones used physical keys and buttons to control various actions, and did not rely on advanced all-touch interfaces. Since 2007, however, the majority of smartphone vendors have followed in Apples footsteps and have employed all-touch graphical user interfaces that use a design similar to the one described in Apples newly awarded patent.
The Cupertino-based company has been involved in patent disputes with Samsung (005930), Motorola (GOOG), HTC (2498) and other companies over the past year, and it is likely we will see its latest patent come into play in the next round of litigation.

Apples latest patent should give Google and its stable of Android device manufacturers reason to worry. Granted just today, the latest addition to the Cupertino-based tech giants stable of intellectual property could be the mother of all smartphone software patents, granting Apple rights to many aspects of touch-based user interfaces, including the display of documents, a camera roll, messaging, and email on mobile devices. The initial filings date back to as early as 2007.
The bad news for Android and its hardware partners is that this patent will likely become a stable of future patent infringement claims coming from Apples court. The effects could be swift and lethal, depending on how descriptions of user interface elements are leveraged. Apple continues to stand by their rights to legally protect and defend the innovations that have arisen alongside their flagship mobile devices, but the granting of such a broad patent could have the negative effect of stifling competition in the marketplace and limiting software advancements.
And the patent could reach its icy fingers into other realms, potentially creating a legal basis to go after the makers of apps and also opening up attacks on other smartphone platforms. Well see how quickly Apple acts on these latest rights, but when they do expect the legal battle to be more grueling than ever.
