Be careful with that line of thinking...the USA is really reluctant to pursue flat out Russian espionage charges.

Its not a good look to expose all the dirt the government has in court, especially when it comes to espionage against the Russians. They seem to hate doing that.
In fact, many cases go unprosecuted because the government doesn't want to reveal shyt in court. The UK for example let a lot of spies off the hook when it was just too hard to prosecute under the law without exposing too much information about how they got their information. Look at Melita Norwood - Wikipedia for example. They knew she was a spy for years...never went after her. Theres a reason for this.
