I got a new job and it's finally time for me to submit my two week notice to my employer. I am freelance worker(consultant) on a W9, and am planning on working the next two weeks in accordance with my contract.

In my contract it only states this as the conditions of leaving:
"It is also agreed, that either the Company or Consultant may terminate this agreement with 14 days written notice without cause. Termination of this contract may be submitted in writing by either Consultant or Company"

Basically I am wondering if my employer can terminate me after receiving my notice? As I read it, it seems that either one of us has to give the other two full weeks to leave, is that assumption correct? If they do try to fire me to cut costs, do I have legal ground to pursue my final two weeks pay?

Was hoping some of you guys could give some free advice before I spend any money consulting with my lawyer

***NOT LEGAL ADVICE***

1) They could argue that your notice was "cause" for termination. Not a very strong argument, but still.

2) They could fire you without cause and hope you don't try to come after them for two weeks pay. If you do, it will be expensive for you and they know this.

3) Contractually, its looks like by giving notice you are in compliance with the contract and that they have no reason to fire you.

not legal advise either...

I submitted my two week at a company and was let go by the end of the day a while back.

They don't want you sharing company information or working on projects with out giving it your all.
They don't have to keep you the entire two weeks. Make sure that your background check and all the other paperwork is set in stone before stating your new job, because technically you are quitting and you will not be eligible for unemployment if that new job decided to not move forward.

You are probably going to a competitor or to another company doing a similar job; most employers don't want you taking knowledge or giving you time to collect files, sh1t saved on your computer, or to corrupt other employees.

Corrupting other employees is one of the main reasons, because you may have been disgruntle or have knowledge that the grass is actually greener on the other side. Companies lose Billions in this nation do to retention issues, they don't need u planting seeds n sh1t.

NTM- you are a contractor- You have no rights. We have 8 contracts where I'm at.. I had to call one today n tell him, no you will not get paid for these holidays and you may be let go after Jan 1. Peace.

Right I'm a contractor and agreed to the terms in which I originally signed. Those terms never once say the company can let me go with out notice.

The contract contains sections of "Proprietary Interest in Business", "NDA of Confidential Information" and "Non-compete". All these simply state that everything I do for the company, is the company's; and that for a year after I leave I will not compete against the company for their clients or disclose company information.

The only part of the contract that states anything about termination says that both parties may terminate this agreement with two weeks notice and without cause.

---

The contract with my new company has already been signed. :myman:

Thanks for the feedback guy, just trying to educate myself if they try anything funny. The past four employees who quit all had to put in a month and that month was respected, the difference now is the company is going down the shythole financially

since this is sorta what I do.. I get a feeling about these things... they probably wont honor ur two weeks. IF they do then it's just so that they don't have to go to court. They have a team that will help them do it without penalty, but it's not worth the trouble. It's great to be a contractor because you make more money, usually... but you really have little rights.

I pocket my entire paycheck each week and was able to write off enough expenses to get my federal tax rate down to 3% last year. I'm fortunate to never get sick, but the paying for my own vacations can get a bit much so I hardly take any and usually work year-round.
