The Federal Court of Rio de Janeiro sentenced the socialite Dayane Alcântara, known as Day McCarthy, to 8 years and 9 months in prison in prison closed for crimes of racial slur and racism.
The case involves the episode of racism committed by the socialite against Titi, one of the adopted daughters of actor Bruno Gagliasso and actress Giovanna Ewbank, in 2017. At the time, Dayane made racist comments in a post made by the couple and called the girl "horrible monkey" and said she had "a monkey broom hair and nose".
After the virtual attacks, Bruno Gagliasso registered a police report in the Civil Police of Rio de Janeiro. The accused was denounced by the Public Ministry to the Justice.
In the sentence handed down on Wednesday (21), Judge Ian Legay, of the First Federal Court of Rio de Janeiro, said that the accused made gratuitous offenses against a 4-year-old child in order to allude to the race and the color of the victim.
“Execrable tests aligned with values forged in time with the daily practice of slavery and the transatlantic trafficking of enslaved individuals, whose contemporary use, in addition to constituting crime, presupposes serious cognitive dissonance in the face of the historical facts that attest to the essentiality of black individuals for the formation of Brazil and their economic, cultural and social wealth,” said the magistrate.
The judge also assessed that the speech was criminal and violating the dignity of the people. Therefore, there is no way to relativize, as the defense, the willful and distinctly offensive character of the speech given by Dayane, in which, after mentioning a discriminatory act suffered by it, it begins to publicly express prejudices against all black people, denaturing what could only be an unfortunate opinion in a criminal content action.
