Question for CDL Holders

My nephew got into an accident on the road. He says his brakes failed so even tho he tried to stop within the right time frame he still ended up tapping the guys car in front of him. The company says he’ll need a subpoena to get the video tape to prove it. Long story short, the company let him go. He just started working with them 6 months ago. He’s applied to other companies but hasn’t received any responses yet. He told me he thinks it’s because they added him to some database that tracks accidents and whether or not it was avoidable. My question is have any of y’all been in this type of situation or have any advice on how he should move forward?

It’s ultimately on the driver to check equipment and know if it’s faulty or not. This will go on his DAC report, and follow him like a scarlet letter. He might be able to get another job but it’ll be undesirable. After some time tho, with a lot of positive (non accidental) miles driven, this blot on his record can fade.

When hiring new drivers, motor carriers are required by law to conduct an investigation into the driver’s safety and performance history. Often, companies conduct these background investigations by obtaining a Drive-A-Check (DAC) report from HireRight, Inc. Negative information on a DAC report can prevent drivers from finding work. He can see what his previous employer put on there that is causing other companies not to hire him. I don't know what he can do to get rid of the report, but he can always get another job. It will just be with a company that doesn't pay well. After 3 years most companies will look past the avoidable accident on his driving report.

Already been answered but pull the DAC. They absolutely report those accidents. Becomes too expensive to insure the new hire.

With time it will be just about erased from his record.

but companies do talk to each other about past employees.

So yeah they see that the company let him go because of an accident.

He'll have to go with what he can find, and stick with it for a few years without any incidents and they will start to overlook his history.

He should try to get a local job right now so he can at least be at home at night, even if it's not that great of a driving job.

He’ll have to take a lesser job with a bottom of the barrel type company and show at least 6-12 months of safe driving on that job to realistically be considered for something better.

I used to tell a lot of people who were “stuck” in low paying dead end jobs to get a cdl. But then one day it hit me that as good as the money can be, it can all easily be taken away from you (for a time) if you fukk up. There’s a lot of competition these days as well.
