You seem to not understand the proportionality clause of self defense. I didn't make the laws. That's just how it is. Every attack is not considered a deadly attack. If someone slaps you, then you can slap or punch them back in self defense. What you cannot do is stab or shoot them dead. Your response to an attack has to be reasonable and proportionate. The courts are very clear about this. To use deadly force when defending yourself you need to be responding to immediate deadly force from your attacker. There is no way around that. The size of the attacker excuse wont work for a murder. Karmelo was a football player too. And to be fair, the courts are generally lenient on the response for self defense in most cases EXCEPT for when someone get killed. That's where the line in the sand is all the extra clauses in the law kick in. Had he grabbed a baseball bat and clocked metcalf and knocked him out with no serious injury then he could possibly use the size factor as an excuse for the disproportionate force and he might get away with it. But since someone died its now a whole different ballgame.
In your other scenario of sitting in a public place you would be in jail and charged with murder. You cannot just shoot somebody for messing with you or attacking you. Again, proportionality in your response is the key. In Texas you will have to prove with evidence that your life was in immediate danger at the time you used deadly force.
Its not just something he has to deal with. Its something that could be critical to this whole case. You cannot claim self defense if you are already committing a crime.
You are overly emotional and your response lacks basic logic. Just like Karmelo and a lot of young boys in our community you are a victim of emotional thinking. You resort to name calling and assumptions when you cannot make a point like a scorned female. Only 1 of my parents immigrated here and I'm born and raised in the inner city. Most of these black boys are dying over short term emotional thinking and there pride and ego is too big to just walk away from conflict. Yes legally you don't always have to if its true self defense.. But if you are smart you will avoid conflict cause its almost never worth it. Even if you manage to get off in court your life is forever changed and now you have to worry about retaliation from the victims family, civil lawsuits, losing your job or being kicked out of school and all types of other issues. Senseless violence happens everyday in this country and homicide is the number one killer of black teen boys. And your way of thinking is the reason why.
He stepped on my shoes so imma kill him.. he touched me so imma kill him... he looked at my girl so imma kill him.. he disrespected me so imma kill him.. That the mentality you promote.
People have gotten off on various scenarios where self defense was claimed. It’s not cut and dry - he hit me so I can only hit him back; he has a knife so now I’m allowed to knife him. This wasn’t a mutual fight where you punched me but in return I stabbed you to death.
This is you and your twin brother singling me out and approaching me aggressively and I don’t fully understand why. I don’t understand why you’re demanding I leave my seat and go back out into the rain, and I don’t understand why the two of you are now threatening to manhandle me. I don’t understand your intentions or how far the both of you are planning on going with this. What I do know is that you’re both a good deal bigger than me and I’m scared as hell. When you threatened me I warned you not to touch me, but that just seemed to anger you more. My god, now you’re attacking me!! So I pulled a knife from my bag and stabbed you once and ran.
You call that emotional. I, and everyone else who has just a little bit of man in him, says that’s a clear cut case of self defense. At the very worst that’ll be manslaughter, and I already explained how that’ll go. But as I said, if his lawyer is worth anything he stands a good chance of getting off and just having to deal with the knife.
And I’m not overly emotional, I’m just not overly whitewashed.
I’d love to see what you’d say if it was two 6 ft 220 lb Black twins approaching a 5’9” 160 lb whiteboy who was minding his own business and demanded he leave. And then tried to jump on him when he didn’t. Your very first questions would be “why did they approach him in the first place?” “who gave those two the authority?” “why did they put their hands on him?” “why didn’t they go get a coach?” and you wouldn’t even let it get to the white boy having to defend himself until all those questions had been answered. You’d want to know “was there anyone else who didn’t attend Memorial sitting under that tent?” “what was it that drew their attention to the whiteboy?” “why did they single him out?” “why did the two of them approach him?” “why didn’t they just go get a coach?”
And we both know it. I won’t even get into you defending the white kids use of physical force, but I know it’d be worthy of the late Johnnie Cochran.
But for the Black kid who’s never been in trouble who was simply minding his own business when forced to defend himself? You’ll blow right past all those troubling questions to get straight to the “murder” which is a perfectly fine charge for the ni _ _ e - oh, sorry, I mean Karmelo.
You told me everything I needed to know about you when you completely ignored the Metcalf twins role in all this, took it upon yourself to determine that Karmelo had no right to be scared, or at least not too scared, and that Karmelo unfortunately being scared anyway and then having the unmitigated gall to defend himself against an unprovoked attack equates to him, years from now, continuing on his “feminine, emotionally out of control” path and stabbing some innocent Black child to death for something trivial like “stepping on his shoes” in a killing that “nobody will care about.” So it’s ok to go ahead and lock him up for murder now, to spare everyone the future misery.
And you say I’m the feminine one. Lol If you’re this feminine in thought, how much more so must you be in action? You would’ve just gotten up and shuffled on out the tent, huh? And if those white boys had decided you weren’t moving fast enough and helped you along with a couple of kicks or cuffs upside the head I guess you would’ve just taken that too.
I understand that in nearly every case it’s better to walk away from a potentially physical confrontation, but gotdamn man. It’s like you’ve not only had every sliver of physical resistance beaten out of you, but even your mind has been successfully conquered as well. Your interpretations of the law are as racially biased towards white people as any lying, racist white man could hope to be.
