Help! Person who hit my car won't call the insurance company

So I got rear ended last week. We got a police report and exchanged info. My bumper is messed up and needs to be fixed, but everytime I call the insurance company, they tell we can't move forward because the other person hasn't contacted them.

It's been a whole week so I'm starting to think they won't call, but if they don't what will happen? Would I have to sue someone?

How can I sue if they won't even contact the insurance company :sadcam:

How bad was the car wreck? The longer this go on document each contact with insurance company etc. Get your lawyer to present it the documentstion as emotional stress more money in your settlement.
My bumper is damaged but my car still drives perfectly fine. Their car was totaled

You should contact your own insurance company. They will fix your bumper and then they will go after the other driver to recover the cost of fixing your bumper.

If you don't have insurance then you have to sue the driver and his/her insurer yourself. It sounds like the driver didn't report the accident, so your next step is to sue if you don't have insurance of your own.

I have insurance. It wasn't my fault, but won't my insurance go up if I report it?

I've had this happen to me before and StateFarm cut me a check to fix my car and then proceeded to go after the guy and Geico, his insurer.

My premium didn't increase since it was not my fault.
