States Motion in Opposition of Defendants Motion for Immunity

Was reading through her deposition and :snoop:


- she shows up to there house middle of the night unannounced, after not living there for more than 2 months

- she hands her husband the cellphone so he can look at some pics of the baby they just had 9 days ago , he finds text messages from another man asking if the baby was his

- he stands infront of the door trying to get answers , she pushes him out the way and at this point has 3 options on how she can LEAVE the house, but does not [evidence to prove it ]

- goes to her car , gets a gun and takes a shot at his head not a "warning" shot at the ceiling [evidence to prove it], the HUSBAND calls the cops she does not

- she post bails and is ordered to stay away from the husband and the step kids , she ignores the order and contacts the kids

- a few weeks after that SHE goes to HIS new house and punches him in the face, again HE calls the cops she doesnt


- they offer her a three year deal for aggravated assault and attempted murder she turns it down because "she feel she did nothing wrong"

I agree she should get some charge, but 20 years is fukking ridiculous. It's because of these retarded mandatory 10-20-life minimums in FL and many other states that state that if you fire a weapon while committing a felony, you get an automatic 20 years that cannot be superseded by judicial discretion. The judge in the case even said he thinks 20 years is too harsh but he can't do anything about it.

And you realize the op posted the states' side of the story against her right? She has it different and said she went there to get some clothes and didn't know he was home and he was the aggressor, which makes more sense that he was the aggressor being that he beat her in the past and put her in the hospital and had a restraining order against him.

:duck: the deposition proves there was only ONE prior cause of domestic abuse , she was taken to a clinic and released soon after with MINOR BRUISING, thats it there was no other bodily harm done to her in any other alleged cases of domestic abuse , those are HER OWN WORDS . Last paragraph pg 2 of the deposition

and she did get some charges, she was offered 3 years for aggravated, but turned it down

Her husband, Rico Gray, 36, admitted in court documents to beating, choking and punching women, including Alexander. "I got five baby-mamas and I put my hands on every last one of them except for one," Gray said in a deposition.

She got fed up, was scared, flipped out and fired a warning shot at him, which she should not have done and should be charged with something, like aggravated assault. She shouldn't be getting no damn 20 years.

I'm totally against stand your ground, I think it's a ridiculous law. But it is the law, and it states that you have no duty to retreat. So as dumb as the law is, I don't see why LEGALLY she shouldn't be able to use it here.

She chose to forgo it the lesser charge, and now is facing 20 years over something that be maybe a couple of months in jail and some probation and counseling.

You should be focused on how absurd the 10-20-life mandatory minimum laws are and the inconsistency in the application of stand your ground laws instead of trying to beat up on an abused woman who did something reckless and stupid.

You fake militant dudes aren't even pro-black at all, you're just pro-black men and often seem to hate black women more than you do white men. If there was a similar scenario where a black man was in Marissa Alexander's position and a white man was in Rico Gray's position, you'd be all aggy ready march in the streets and talking about how racist the AmeriKKKan justice system is.

Read the clinic report , so she got her ass beat and thrown around but had no cuts , or abrasion or even bruising??? not say she aint getting ruffed up but what do you expect from this person

A few months after Alexander was released on bail on orders to have no contact with Gray, she got into an altercation with him at his home that gave him a black eye, Corey said. Alexander was charged with battery.

“Instead of her trying to work toward a resolution, about four months into this thing, claiming to be so afraid of this man, she went barging to his house and attacked him,” Corey said. “So it didn’t show much of her being remorseful of what happened and being a peaceful person.”
