California High School math teacher smashed his female student, catches 4 felonies

SANTA CLARA -- A Santa Clara High School math teacher accused of having sex with a 17-year-old female student told police he had sex with the girl on at least four separate occasions, according to police reports.

Hugo Cortes, 32, -- identified as Hugo Cortes Guzman in the police reports -- made his first court appearance Thursday and was charged with four felony counts of unlawful sexual intercourse with a minor more than three years younger than the defendant. He remains in jail.

During the investigation, police searched Cortes' classroom at Santa Clara High and found girls' bras and underwear, two unopened condoms, other female clothing and a copy of the erotic novel "50 Shades of Grey," according to police reports.

Cortes teaches algebra support, AP statistics and AVID, a college preparation program. He is on indefinite leave from teaching, according to Santa Clara High School Principal Greg Shelby.

Police began investigating Cortes after a school janitor reported seeing the teacher and a girl alone in a classroom on Sept. 20 at about 7 p.m., a Friday night. The janitor told police the girl and Cortes were sitting on opposite ends of his desk watching the R-rated movie "This is the End, " police reports say.

The janitor cleaned inside the room for about five minutes and went to report what he saw to the head custodian.

The janitor said he was told by the head custodian "we've seen that before." The janitor told police the response made him think it was a regular occurrence, according to police reports.

As he was cleaning other rooms at the high school, he saw Cortes and the girl sitting inside a black Jeep. He said the teacher was talking to her, and she was giggling.

The man returned to Cortes's classroom to vacuum and noticed a "nasty" mattress under a desk with blankets and pillows, police reports say. He looked inside a cabinet and found girls' clothing, including bras and underwear.

Disturbed by what he found, he again told his supervisor, who agreed to tell the principal on Monday, police reports say.

The janitor thought about the situation all weekend. When he went to work Monday at his home school, he sought the advice of the secretaries. They told him to report it to his union representative, who in turn called a school district administrator.

The administrator called Santa Clara police.

During the investigation, police interviewed Cortes, who told them he and the girl had sex on four occasions inside his Jeep, according to police reports. Cortes told police he was homeless and spent about most of his time living out of his vehicle.

Another female student told police she had heard rumors about Cortes having sex with students but did not believe it, police reports say. The student told police that the bed in Cortes' classroom was available for students to take naps during the day.

Inside the Jeep, police found a Christmas card written from the girl to Cortes which read "You are honestly my best friend. I can tell you anything. No secrets. I will always be there for you, no matter what happens. I love you, no matter what decisions you make."

Police said Cortes told them that he and the girl discussed what would happen if anyone knew about their sexual encounters.
