Civil lawsuit - doesn't have the same burden of proof as a criminal action. From this case, it sounds like there could be a parallel proceeding, meaning there is still an ongoing investigation into any criminal action while her attorney is proceeding with the civil action. Any information or evidence obtained during the civil proceeding, is turned over to the prosecution. Keep in mind that criminal = breaking of laws that violate society (the state); civil = laws that affect an individual or entity (the victim). The prosecution has to determine if there is enough evidence to pursue the criminal matter against him. That's for the prosecuting atty to decide; she could have filed a criminal complaint but that doesn't automatically mean that charges will be filed. In the civil case - she doesn't need "permission" from the state to pursue her own case against him in civil court. The main factor here it seems is Intent. I also think his legal team is focusing on the fact that she kept going back and the videos showing her voluntary interactions with him over the course of time. I don't have all the details but it's likely that she's filing for damages - personal injury, emotional and mental distress, recovery of monetary expenses. Just like with the Bill Cosby case- The women who weren't part of the criminal case, are still pursuing their civil cases.Somebody with law knowledge please help me out with this, how in the hell can you sue someone for a crime without ever having filed an official police report?
