HELLERTOWN, Pa. - The American Civil Liberties Union, the ACLU of Pennsylvania, and Dechert LLP filed a lawsuit in federal court Thursday against the Saucon Valley School District over the district's decision to not allow the After School Satan Club to meet in district facilities.

The ACLU says the district violated the First Amendment by not allowing the club to meet.

The complaint requests emergency and permanent injunctive relief against the district, as well as compensatory and nominal damages and attorneys’ fees.

“The Saucon Valley School District’s decision to cancel the After School Satan Club in response to public opposition sets a dangerous precedent,” said Sara Rose, deputy legal director of the ACLU of Pennsylvania. “The First Amendment protects the expression of unpopular or controversial views from government censorship. Once the district opened up school facilities to outside use, it was bound by the First Amendment to grant equal access to all groups, regardless of their religious beliefs or viewpoints.”


The school district originally agreed to the club, but later rescinded that approval. The superintendent said the club failed to meet all district requirements and led to major disruptions, one of those being a threat called into the school by a North Carolina man who's now facing charges.

The ACLU says once the district mentioned that threat as a reason for nixing the club, it's looked at as a "Heckler's Veto," something it says goes against the First Amendment.

“The After School Satan Club provides a critical space for students who may feel unwelcome at other after-school religious clubs,” said June Everett, director of TST’s ASSC programming. “By prohibiting the ASSC from meeting in school facilities, the district is sending a discriminatory message to the club’s students that they are second class and don’t deserve the same opportunities as their peers.”

i love it when they use their favoritism towards Christianity against them.
keep church and state separate and you won't have these problems. These are the same people that are supposedly against indoctrination of kids, and yet try their damndest to covert everyone to Christian through our k-12 education.
I remember when i was kid we we're required to say grace as a class before lunch time.

L. SAUCON TWP., Pa. - A federal judge has ordered Saucon Valley School District to allow a controversial club to meet at the middle school.

The decision on the After School Satan Club was issued Monday, after a hearing on April 20.

The ruling says the district must allow the club, through the Satanic Temple, to meet at the times and places in the previous agreement made on Feb. 16.

The district superintendent had rescinded that agreement a week later, on Feb. 24, after a threat related to the club shut down the district for a day.


The judge's order says Saucon Valley had rescinded approval because of the Satanic Temple's "controversial views on religion" and the community's negative reactions to the club, therefore violating the group's First Amendment rights.

The district had argued that the club violated district facility policies when it advertised on social media. Those social media postings, the district argued, led to a North Carolina man making a threat against the middle school relating to the club, leading to school disruptions.

"Although the Satanic Temple's objectors may challenge the sanctity of this controversially named organization, the sanctity of the First Amendment's protections must prevail," wrote Judge John Gallagher, with the U.S. District Court for the Eastern District of Pennsylvania, in the decision.

The judge did, however, deny one part of the Satanic Temple's request. The judge ruled that Saucon Valley does not have to send home permission slips for the After School Satan Club with students.

The After School Satan Club does not believe in introducing religion into public schools and will only open a club if other religious groups are operating on campus. ASSC exists to provide a safe and inclusive alternative to the religious clubs that use threats of eternal damnation to convert school children to their belief system. Unlike our counterparts, who publicly measure their success in young children's "professions of faith," the After School Satan Club program focuses on science, critical thinking, creative arts, and good works for the community. While engaged in all of these activities, we want clubgoers to have a good time.

AFTER SCHOOL SATAN CLUB MISSION

Proselytization is not our goal, and we’re not interested in converting children to Satanism. After School Satan Clubs will focus on free inquiry and rationalism, the scientific basis for which we know what we know about the world around us.

We prefer to give children an appreciation of the natural wonders surrounding them, not a fear of everlasting other-worldly horrors.
