STOCKTON - A former child star from “The Hughleys” sitcom was acquitted Friday of murder and gang charges stemming from the 2011 stabbing of a 26-year-old man outside a Stockton nightclub.
STOCKTON - A former child star from “The Hughleys” sitcom was acquitted Friday of murder and gang charges stemming from the 2011 stabbing of a 26-year-old man outside a Stockton nightclub.
Dorjan “Dee Jay” Daniels, 24, of Fontana played the son of comedian D.L. Hughley on the 1990s sitcom. Hughley, the show’s star, testified in a Stockton courtroom during the trial as a character witness for Daniels.
Marcus McCliman, 26, a friend of Daniels, was found guilty of voluntary manslaughter and the use of a knife in the Aug. 26, 2011, death of John Joseph Lewis, while a third defendant, Djuane Nunley, 27, was also cleared of all charges.
“I don’t think the victim got the justice he should have gotten,” said San Joaquin County Deputy District Attorney Janet Smith, who prosecuted the case. “I feel badly.”
Smith said she talked to the jury afterward and they did not mention Hughley’s testimony given on behalf of Daniels. Smith said she did not feel that the star’s hourlong testimony swayed jurors. Hughley said in court that he had past ties, as well, to the Bloods street gang, Smith said.
The trial followed the Aug. 26, 2011, slaying outside Chitiva’s Bar and Grill in the waterfront buildings. A fight erupted, and Lewis was stabbed, causing a fatal injury.
Officials believed McCliman killed Lewis, but all three were cleared of first-degree murder charges, which carries a 25-year prison sentence.
McCliman could be sentenced to a maximum of 11 years in state prison for the voluntary manslaughter conviction and an additional year for using a knife. The three were also acquitted of gang charges and the attempted murder of a woman.
Daniels and Nunley, who have been in custody at the San Joaquin County Jail since their August 2011 arrests, were expected to be released late Friday.
McCliman, still in jail, is expected back before San Joaquin County Superior Court Judge George Abdallah on Feb. 25.
